In 2009, Atkins-Swanson applied and qualified for participation in the Self-Directed Personal Assistance Service Program, a government-sponsored program that allowed Atkins-Swanson to direct health-related tasks. Consumer Direct was Atkins-Swanson’s provider agency and provided administrative services to Atkins-Swanson during the course of her participation in the program. In 2013, Atkins-Swanson succumbed to a fatal overdose of buspirone. Lee Swanson, on his own behalf and on behalf of Atkins-Swanson’s estate, filed this action against Consumer Direct, alleging wrongful death, survivorship, and breach of contract. The district court granted summary judgment for Consumer Direct, concluding that Consumer Direct was statutorily immune from liability because it was not directing the personal-care services. The Supreme Court affirmed, holding that the district court correctly granted Consumer Direct’s motion for summary judgment and did not err by denying Swanson’s motion to alter or amend the judgment on the ground that the claims were foreclosed under Mont. In 2013, Felicia Farris filed an amended complaint alleging that, in 2005, she entered into a contract with Cynthia Conger, d/b/a Conger Wealth Management (Conger), entitled “Wealth Management Agreement.” In 2008, Farris sought to have Conger transfer sufficient funds from Farris’s Fidelity Investment Account to Farris’s personal checking account so that Farris could purchase certain property prior to a foreclosure sale. Conger failed to transfer the funds, and the property was sold to a third party. Farris ultimately obtained the parcel at additional costs. Farris brought this action against Conger in 2013. Conger moved for dismissal and for summary judgment, asserting that the cause of action sounded in the tort of negligence and, therefore, was barred by the three-year statute of limitations for tort actions. Farris argued that her cause of action was for breach of contract, and thus the five-year statute of limitations applied. The circuit court granted summary judgment, finding that Farris’s complaint sounded in negligence and, consequently, was time-barred. The Supreme Court reversed, holding that the circuit court erred in failing to apply the five-year statute of limitations for contract claims, making Farris’s cause of action timely. View "Farris v. Homeowners obtained loans from Bank for the construction of a new home and entered into an agreement with Contractor to complete the new home construction. When Homeowners defaulted on payments owed to Contractor and on both loans, the house was sold at foreclosure, and Homeowners filed for bankruptcy. Contractor filed a fourth amended complaint against Homeowners, who were later dismissed as parties, and Bank. Following a trial the court granted summary judgment for Bank on Contractor’s claims of fraud and civil conspiracy. The Supreme Court reversed. After remand, Contractor filed a fifth amended complaint, which differed from the fourth amended complaint in several respects. The district court determined that the election of remedies doctrine and judicial estoppel required a dismissal of Contractor’s claims. The Supreme Court reversed, holding (1) Contractor’s claims were consistently premised on the existence of a contract, and therefore, no election was required; and (2) Contractor’s claims were based on different facts and obligations, and therefore, both could be pursued. After a jury found CSX solely liable for injuries suffered by an employee of General Mills and awarded the employee damages, CSX filed this action for indemnification from General Mills. The district court dismissed on the ground that the contract between the parties barred indemnification for damages arising from CSX's sole negligence. In reaching this result, the district court applied a federal rule of collateral estoppel to bar relitigation of the relative fault of General Mills for the injury suffered by its employee. The court held, however, that federal common law adopts the state rule of collateral estoppel to determine the preclusive effect of a judgment of a federal court that exercised diversity jurisdiction. Accordingly, the court reversed and remanded for the district court to determine whether collateral estoppel bars the complaint of CSX for indemnification. The court declined to decide the dispute regarding one element of collateral estoppel as defined by Georgia law: the earlier litigation must have been between identical parties. The court also declined to decide the alternative argument raised by CSX, whether the Sidetrack Agreement requires indemnification assuming CSX was solely at fault. View "CSX Transportation, Inc. v. Natalie Heslop overdosed on prescription drugs. The next day, Natalie rolled her truck down an embankment. Natalie informed the responding police officer, medical personnel, her family, and an insurance adjuster that the accident had been a suicide attempt. Natalie’s insurance policy provided that it would exclude coverage to any injured person “if the person’s conduct contributed to his injury…by intentionally causing injury to himself.” Natalie and her husband, Brandon Heslop, attempted to collect from Bear River Mutual Insurance Company under both a personal injury protection claim for Natalie’s personal injuries and a property damage claim for damage to the truck. Bear River denied the claims based on Natalie's admission that she intended to drive down the embankment. The Heslops subsequently filed a complaint against Bear River. The district court granted summary judgment to Bear River as to both the personal injury claim and the property damage claim. The parties in this case disagreed over the ownership and operation of an irrigation system on a ranch. Plaintiff filed a complaint against Defendants, arguing that Defendants had converted his property by exercising unauthorized dominion or control over the irrigation system, that Defendants had been unjustly enriched through their possession of the irrigation system, and that Defendants had caused him damages. Defendants filed counterclaims against Welu, alleging trespass and breach of contract. The district court entered judgment in favor of Defendants. The Supreme Court affirmed, holding that the district court did not err in (1) determining that the entire pivot irrigation system constituted a fixture; (2) concluding that Defendants did not breach the parties’ agreement concerning the pivot irrigation system; and (3) did not err in determining that Defendants were not unjustly enriched. Keeneland Association, Inc. entered into a contract with Appalachian Racing, LLC to preserve its interest in purchasing Appalachian Racing’s ownership of the racing track Thunder Ridge. Floyd County held bonds that were to be paid upon Keeneland’s purchase of Thunder Ridge. While the contract was pending, Keeneland applied for a license with the Kentucky Horse Racing Commission on behalf of Cumberland Run, LLC to operate another racing track. The Commission issued a public notice that it would review and consider the application. Appalachian Racing, joined by Floyd County, sued the Commission on a theory of aiding and abetting fraud and tortious interference with a prospective advantage. The circuit court issued a restraining order prohibiting the Commission from considering or taking any action on the license application. The Commission then sought a writ of prohibition to prevent the circuit court from enforcing its restraining order. The court of appeals granted the Commission’s request determining that the circuit court violated Kentucky’s separation of powers doctrine in issuing the order. The Supreme Court affirmed, holding that there was nothing in the present suit that authorized the circuit court to prevent the Commission from considering Keeneland’s application. Plaintiffs-Appellants James and Karen Feggestad appealed the district court’s order dismissing their complaint against defendants-appellees, Kerzner International Bahamas Limited, Kerzner International Limited, Island Hotel Company Limited, Paradise Island Limited, and Brookfield Asset Management Inc. (collectively, "Kerzner"), on the basis of a valid forum selection clause. The Feggestads made reservations at the Atlantis Resort on Paradise Island, Bahamas (Atlantis) and received a reservation confirmation via their email address. The confirmation contained a section titled "Terms and Conditions" and included a hyperlink advising guests to view the other terms and conditions. This link provided advance notification that any dispute between the guest and the hotel or any affiliated company must be litigated exclusively in the Bahamas and that upon arrival at the Atlantis, the guest would be required to sign a registration form that included a Bahamian forum selection clause. When the Feggestads checked into the hotel, the resort asked them to sign a registration card, which also included an "acknowledgement, agreement and release," which also listed the clause at issue here. Several days after their arrival at the Atlantis, Mr. Feggestad slipped and fell on a wet sidewalk and sustained severe personal injuries. He later sued, and the forum-selection clause became an issue. After reviewing the record, reading the parties briefs and having the benefit of oral argument, the Fifth Circuit affirmed the district court’s dismissal. View "Feggestad v. This case arose out of dispute between the Association of Apartment Owners of Royal Aloha, its former property managers, and its former commercial tenants. The AOAO installed an electricity submetering system and submitted readings of each unit’s electricity submeter to the managing agent, who would bill each owner for electricity. For certain years, some commercial tenants were never billed for electricity, and some were erroneously billed for a portion of those electricity costs. The AOAO sued its former property managers for, inter alia, breach of contract for the billing errors. The AOAO also sued the commercial tenants to recover the unbilled or erroneously billed electricity costs. The circuit court granted summary judgment for all defendants, concluding that all claims were barred under the doctrine of laches. The Intermediate Court of Appeals reversed, concluding that the defense of laches applies only to equitable claims. Plaintiffs Michael Rose and RC&D, Inc. filed suit against Defendants Stephen Brusini and the law firm Orson & Brusini Ltd. alleging professional negligence and breach of contract. The hearing justice granted summary judgment for Defendants, concluding that there was no evidence of proximate cause linking Defendants’ alleged negligence and any damages Plaintiffs may have suffered. The Supreme Court vacated the judgment of the superior court, holding that Rose submitted sufficient competent evidence to preclude the entry of summary judgment for defendants on a question of fact relating to Defendants’ liability.
