The United States Court of Appeals for the Eleventh Circuit certified two questions to the Georgia Supreme Court: "(1) Did the Georgia Insurance Commissioner act within his legal authority when he promulgated Ga. Comp. R. & Regs. 120-2-20-.02, such that a multiple-line insurance policy providing first-party insurance coverage for theft-related property damage must be reformed to conform with the two-year limitation period provided for in Georgia's Standard Fire Policy, Ga. Comp. R. & Regs. 120-2-19-.01?; and, (2) is this action barred by the Policy's one-year limitation period?" These questions arose from a dispute over Petitioner Ricardo White's purchase of a homeowner's insurance policy from Respondent State Farm Fire and Casualty Company. The insurance policy was a first-party insurance contract that provided multiple-line coverage, including coverage for loss or damage caused by both fire and theft. The policy contained a limitation provision stating that a lawsuit against State Farm must be brought "within one year of the date of loss or damage." After his home was burglarized in January 2008 (within the period of coverage), Petitioner filed a claim for the loss of more than $135,000 in personal property. State Farm denied the claim based on its determination that Petitioner misrepresented material information in filing his claim. Waiting more than one year after his date of loss, Petitioner filed a June 2009 complaint against State Farm in state court alleging claims for breach of contract, bad faith, and fraud. Upon review of the facts of this case, the Supreme Court found that: (1) the Georgia Insurance Commissioner did not act within his legal authority and (2) this action was barred by the one-year limitation period in his insurance policy.

These cases arose from a declaratory judgment action filed by a trustee seeking to determine the effect of an in terrorem clause in an express trust. At issue was whether appeals that involved the proper interpretation of a trust provision came within the court's general appellate jurisdiction over "equity cases," Ga. Const. of 1983, Art. VI, Sec. VI, Par. III(2), because the resolution of that legal issue would affect the administration of the trust. Consistent with the court's precedent on this question, the court concluded that such cases did not come within its equity jurisdiction.

The United States Court of appeals asked the court to answer a question that stemmed from a dispute over the proper interpretation under Georgia law of a contract insuring real property. The primary issue presented was whether the court's ruling in State Farm Mut. Auto. Ins. Co. v. Mabry, a case involving an automobile insurance policy wherein the court held that a provision requiring the insurer to pay for loss to the insured's car required the insurer to also pay for any diminution in value of the repaired vehicle, was applicable. The court held that its ruling in Mabry was not limited by the type of property insured, but rather spoke generally to the measure of damages an insurer was obligated to pay.

Circle Y filed a complaint alleging, among other things, breach of contract when the school district terminated a construction management services contract with Circle Y. The trial court denied the school district's motion to dismiss and the court of appeals affirmed. The court held that, in light of the determination by the court of appeals that the trial court correctly denied the motion to dismiss because Circle Y's complaint alleged facts that, when taken as true, established that the contract was not void as a matter of law due to voter approval of the educational local option sales tax, it was not necessary for the court of appeals to construe OCGA 20-2-506(h) in order to resolve the appeal. Accordingly, the court remanded to the court of appeals with direction that it vacate that portion of the Division order that addressed OCGA 20-2-506.

Appellee, as executrix of the estate of her father, and her sister, brought a breach of contract action in which they asserted that their father's second wife, appellant, contractually waived her right to retain the proceeds of their deceased father's employer-provided 401K plan and life insurance policy by entering a settlement agreement incorporated into an order of separate maintenance executed approximately a year prior to the father's death. At issue was whether the court of appeals erred in finding that decedent's children could maintain a state law action against the decedent's surviving spouse to recover proceeds distributed to the spouse as the beneficiary of the decedent's ERISA-governed benefits plans, 29 U.S.C. 1001 et seq., where the state law claims were based on a contention that the spouse waived her rights to such proceeds. The court answered in the negative, concluding that, in this case, since the proceeds of the ERISA-covered plans were paid out to appellant and were no longer in the control of the plan administrator, the trial court erred when it dismissed appellees' breach of contract claim against appellant.

Lisa Krebs sued Carmen McReynolds and GM for serious injuries she received when McReynold's car struck the GM vehicle in which Krebs was a passenger. McReynolds subsequently appealed the trial court's rulings. The court granted certiorari to consider two questions: (1) Did the Court of Appeals correctly construe OCGA 51-12-33 to require a trier of fact to apportion an award of damages among multiple defendants when the plaintiff was not at fault?; and (2) Did the Court of Appeals correctly find that McReynolds's insurer made a counteroffer in response to Krebs's settlement demand? The court answered both questions affirmatively. The court held that in applying section 51-12-33, the trier of fact must "apportion its award of damages among the persons who were liable according to the percentage of fault of each person" even if the plaintiff was not at fault for the injury or damages claimed. In light of this holding, there was no error in the dismissal of McReynolds's cross-claims for contribution and set-off against GM. The court construed the response by McReynolds's insurer to Krebs's settlement offer, proposing to resolve the hospital and other liens "as part of this settlement," as a counteroffer rather than an unconditional and unequivocal acceptance. Accordingly, no binding settlement was formed.

Stiles Apartment filed suit asserting ownership over a parking area and sought interlocutory and permanent injunctive relief to prohibit ACC from exercising any control over the parking area. ACC counterclaimed for declaratory judgment, ejectment, and breach of contract. The trial court issued an order granting the request for injunctive relief against ACC's efforts to assert ownership or control over the parking area but denied a request to enjoin ACC from arresting Mr. Stiles for towing vehicles from the parking area. ACC appealed from the order. The court held that there was evidence authorizing the grant of interlocutory injunctive relief and the trial court did not abuse its discretion. The court rejected ACC's defenses of laches, waiver, and the statute of limitations. Accordingly, the court affirmed the judgment.

BB&T brought suit against Borrowers and Guarantors for more than $19 million then due under certain promissory notes at issue. The promissory notes were executed as a result of BB&T's issuance of 16 loans for residential housing development. In Case No. S1161728, appellants argued that the Court of Appeals in holding that no valid foreclosure sale occurred, erroneously relied on its determination that BB&T did not satisfy the Statue of Frauds. The court held that there were no valid foreclosure sales to prevent BB&T from suing on the notes in the absence of confirmation under OCGA 44-14-161, regardless of whether there was a valid executory sales contract which satisfied the Statute of Frauds. In Case No. S11G1729, the court held that, although the Court of Appeals correctly held that none of BB&T's claims was barred by its failure to seek confirmation after the foreclosure auctions, that court did err in holding that the 2008 guaranties did not sufficiently identify any pre-2008 notes and that the 2008 Guarantors were estopped by BB&T's part performance from asserting a Statute of Frauds defense to BB&T's claims against them on pre-2008 notes.

In 2007, Sea Gardens petitioned under OCGA 23-3-60 to quiet title to waterfront property in McIntosh County. Appellants appealed from the trial court's entry of a consent judgment purporting to resolve their ongoing dispute with Sea Gardens over title to the property at issue. Because both parties did not in fact consent to all terms of the consent judgment, the trial court erred in issuing it, and therefore the court vacated and remanded for further proceedings in the trial court.

This appeal involved a title to a house and lot in a residential subdivision in Forsyth County. The trial court granted plaintiffs' motion for summary judgment and defendants appealed. The court held that the trial court properly rejected defendants' claim of bona fide purchaser status; defendants' argument that the trial court erred in holding that the children acquired a collective two-thirds interest in the property by virtue of the 1998 quitclaim deed from their father was without merit; the trial court properly dismissed defendants' claim for equitable subrogation; the trial court did not err in dismissing defendants' counterclaim for unjust enrichment; and the trial court did not err in dismissing defendants' laches defense. Accordingly, the court affirmed the judgment.
