Northeast Cmty. Sch. Dist. v. Easton Valley Cmty. Sch. Dist.
This case involved three small school districts, Northeast Community School District, East Central Community School District, and Preston Community School District. In 2010, the school boards of Northeast and East Central entered into a whole grade sharing agreement. Thereafter, citizens from Preston and East Central voted to reorganize their districts and merge the districts together into a new school district called Easton Valley Community School District (Easton). The Easton school board subsequently sent a notification of cancellation of the agreement to the superintendent of Northeast, claiming that when East Central ceased to exist the agreement was null. Northeast filed a petition for declaratory action and mandamus and then amended its petition alleging repudiation of the agreement. The district court granted summary judgment for Easton, concluding (1) the agreement and the reorganization were valid but that the two were in direct conflict, and (2) the East Central school board did not have the ability to bind Easton as its successor corporation. Baldwin v. Board of Supervisors for the University of Louisiana System
In 1998, Jerry Lee Baldwin entered into a written agreement with the Board of Supervisors for the University of Louisiana System to serve as the head football coach at the University of Southwestern Louisiana, now University of Louisiana at Lafayette (UL). The contract provided that Baldwin’s employment with UL would last until January 31, 2003. By letter dated November 27, 2001, Baldwin was “relieved of [his] duties” as UL’s head coach effective November 26, 2001, after winning only six of twenty-seven games (an 18% win record). Baldwin continued to receive his full monthly salary and other employee benefits from UL including health insurance, accrual of leave time, and accrual of retirement credits for the remainder of the contract term. Baldwin sued the Board over the contract. Defendants sought review of the court of appeal’s determination that the coach’s contract had been terminated, which triggered a contractual obligation to provide notice. Interpreting the contract in its entirety, the Supreme Court found that the appellate court erred in finding that the failure of notice constituted a breach of contract under the facts of this case. Accordingly, the Court reversed the appellate court’s decision and reinstated the summary judgment rendered by the trial court, which dismissed the coach’s breach of contract claim against defendants.View "Baldwin v. Jefferson County Bd. of Educ. v. Hon. Brian C. Edwards
A former teacher, Terum Hopper, filed a wrongful termination action against the Jefferson County Board of Education. The Board moved for summary judgment, arguing that Hopper’s tort claims were barred by governmental immunity and that Hopper was required to pursue the administrative remedies set forth in Ky. Rev. Stat. 161.790 to challenge the termination of his employment contract. The trial court granted the summary judgment motion as to the governmental immunity claims but denied the motion as to the breach of contract claims, declaring that Hopper was entitled to file suit on these claims rather than pursue administrative remedies. The Board sought a writ prohibiting the lower court from trying Hopper’s breach of contract claims. The court of appeals denied the writ, concluding that the circuit court had subject matter jurisdiction over the claims and that the Board had an adequate remedy. The Supreme Court reversed and granted the writ, holding that because Hopper filed an action in the circuit court without first exhausting the administrative remedies provided in section 161.790, the circuit court did not have subject matter jurisdiction to hear his claim. Ortony v. Northwestern Univ.
In 2007, Professor Ortony of Northwestern University, asked Dean Peterson, for a year’s leave to visit another university. Peterson proposed to authorize paid leave during calendar year 2008 and the 2011–12 academic year, if Ortony would teach during the intervening time and then retire. Peterson’s letter stated: “At your request, I will accept your resignation ... effective with your retirement on August 31, 2012” and specified when Ortony would be on paid leave and when he would carry a full teaching load. Ortony signed the letter in June, 2007. In 2011 Ortony did not want to retire and insisted that he had not agreed to do so. He filed an EEOC charge under the Age Discrimination in Employment Act, 29 U.S.C. 626, and subsequently filed suit. The district court granted the University judgment on the pleadings. The Seventh Circuit affirmed. Northwestern did not terminate Ortony: it bought out his tenure by promising him five years’ pay for three years’ work. That he changed his mind does not make the 2007 contract less binding. The court rejected Ortony’s argument that he “construed the [contract] to set out a tentative plan under which he could leave the University, if he chose to do so, in five years.” View "Ortony v. Wilson v. Career Educ. Corp,
Wilson worked as an admissions representative, recruiting students to enroll in CEC’s culinary arts college. CEC admissions representatives worked under a contract that gave them a bonus for each student they recruited, above a threshold, who completed a full course or a year of study. In 2010, the U.S. Department of Education issued regulations prohibiting this kind of arrangement; new rules were scheduled to take effect in July 2011. CEC decided announced to its admissions representatives that it would cease paying bonuses at the end of February 2011 and that no bonuses would be regarded as earned by that date unless the relevant student had completed the year of study or course by that time. Wilson sued, asserting that CEC owed him bonuses for “pipeline” students, whom he had recruited and who were on target to complete a full course or year of study between March and June 2011. The district court dismissed. The Seventh Circuit reversed, finding that Wilson successfully pleaded that CEC exercised its right to terminate the agreement in bad faith and in violation of the implied covenant of good faith and fair dealing. State ex rel. Smith v. W. Va. Crime Victims Comp. Fund
In 2008, Donte Newsome, a university student, was the innocent victim of murder. In 2009, Newsome's mother, Angela Smith, submitted an application to the court of claims seeking reimbursement from the West Virginia Crime Victims Compensation Fund for medical expenses, funeral and burial costs, and student loans owed by Newsome at the time of his death. Smith was granted an award for medical expenses and funeral and burial costs but was denied compensation for the student loans. After a hearing, the court of claims denied Smith's request for reimbursement of her son's unpaid student loans pursuant to the West Virginia Crime Victims Compensation Act, concluding that student loans are contractual obligations that cannot be reimbursed under the Act. The Supreme Court denied Smith's petition for writ of certiorari, holding that Newsome's student loans were not subject to reimbursement under the Act because they were not loans that Newsome was unable to receive or use, in whole or in part, prior to his death. Virginia College, LLC v. Blackmon
The trial court denied defendant Virginia College's motion to compel arbitration. Because the plaintiffs failed to allege sufficient facts to support a claim that they were fraudulently induced to agree to the arbitration provision, the Supreme Court reversed and remanded the case for further proceedings. Sacco v. Cranston Sch. Dep’t
Plaintiffs brought suit against Defendant, the Cranston School Department, seeking grievance arbitration of adverse actions taken against them as to their respective coaching positions at Cranston West High School. Plaintiffs, both of whom were teachers at Cranston West, separately filed grievances against Defendant in accordance with the collective bargaining agreement (CBA) that was in place between the Cranston Teacher's Alliance and the school department. Defendant responded that the CBA did not apply to Plaintiffs in their capacity as coaches, and it refused to submit to arbitration. Plaintiffs filed suit, seeking a declaratory judgment that they were entitled to binding arbitration as guaranteed by the CBA. The superior court ruled in favor of Defendant, determining that Plaintiffs, in their capacity as coaches, were not entitled to avail themselves of the CBA's grievance procedures. The Supreme Court affirmed, holding (1) the trial justice was correct in determining that Plaintiffs' coaching positions were contractually distinct from their teaching positions and did not constitute professional employment; and (2) Plaintiffs in their coaching capacities had no right to pursue relief based on the rights bargained for by the alliance on behalf of its teacher-members and as contained in the CBA. Bldg. Materials Corp. of Am. v. Bd. of Educ.
For some years, the Board of Education of Baltimore County belonged to a governmental group purchasing consortium, which competitively bid a roofing services contract on behalf of its members. The Board relied on that contact to fulfill its needs for roofing repair services. Appellant Building Materials Corporation of America, a nationwide manufacturer of roofing materials, questioned the Board's authority for that practice under the pertinent statutes. The circuit court granted summary judgment in favor of the Board. The Court of Appeals affirmed, holding that when viewed in the context of the entire education law and regulations promulgated under that law, the competitive bidding statute did not bar the Board from using its membership in an intergovernmental purchasing consortium for the procurement of roofing repair services. United States v. Watkins
Watkins, an African-American, worked for the school district, overseeing security systems. Fultz supervised Watkins and, relying on Watkins’s advice, Fultz awarded Vision a $182,000 annual contract for service of security cameras. Vision’s president, Newsome, testified that Watkins called her and talked about a “finder’s fee.. Newsome went to Cleveland for a customer visit. She e-mailed Watkins and he replied: “Absolutely$.” Newsome believed that Watkins expected her to pay him at their meeting. Newsome notified Fultz. At the meeting, Watkins requested “an envelope.” After Fultz contacted police, the FBI recorded meetings at which Newsome gave Watkins $5,000 and $2,000. A white jury convicted on two counts of attempted extortion “under color of official right” (Hobbs Act, 18 U.S.C. 1951), and one count of bribery in a federally funded program, 18 U.S.C. 666(a)(1)(B). The court determined a total offense level of 22, applying a two-level enhancement for obstruction of justice, another two-level enhancement for bribes exceeding $5,000, and a four-level enhancement for high level of authority, plus an upward variance of 21 months under 18 U.S.C. 3553(a), and sentenced Watkins to six years’ incarceration. The Sixth Circuit affirmed, rejecting challenges to jury instructions, sufficiency of the evidence, the jury’s racial composition, and the reasonableness of the sentence.View "United States v.
